CONFLICT OF LAWS
B. Lifshitz, "The rules governing conflict of laws between a
Jew and a Gentile according to Maimonides", Mélanges à
la mémoire de Marcel-Henri Prévost (Paris: Presses Universitaires
de France, 1982), 179-189. - Noting that Jewish law leaves relatively little
scope for (internal) conflict of law rules, the author considers contracts
between parties whose customs differed, claims made by one party that the
law of the state, rather than Jewish Law, should apply (as a result of dina
demalkhuta dina), and litigation in Jewish courts between a Jew and
a Gentile. The latter is studied with particular reference to the rulings
of Maimonides. (B.S.J.)
