DEEDS
Mordecai David Cohen, Edut ushetarot, Jerusalem: Makhon Yerushalayim,
1983, Pp. 420. - The question of evidence given in writing, as opposed to
verbal testimony in the Court, is one of the most complicated in Jewish
legal theory. The central problem is the apparent contradiction between
the rejection of testimony sent in writing to the Court and the acceptance
of written evidence in deeds of sale and the like. If the law refuses to
recognise written evidence how are shetarot validated? All the historical
sources are surveyed, weighed and analysed in this very learned volume,
though entirely on traditional lines. (L.J.)
